Yes. The re-subscribe failure above is a CAN-SPAM issue, not a GDPR one. CAN-SPAM carries fines of up to $50K per violation, and emailing a shopper who opted out because their next checkout counted as a new opt-in is exactly that violation. US-only brands also ship to Canadian, UK and EU shoppers more often than they expect, and those orders carry those rules.
